Processes leading to acute myeloid leukemia discovered
ScienceDaily (Jan. 30, 2012) ? Researchers at UC Santa Barbara have discovered a molecular pathway that may explain how a particularly deadly form of cancer develops. The discovery may lead to new cancer therapies that reprogram cells instead of killing them. The findings are published in a recent paper in the Journal of Biological Chemistry.
The UCSB research team described how a certain mutation in DNA disrupts cellular function in patients with acute myeloid leukemia (AML). The researchers were prompted to study this process by another research team's discovery that AML patients have a mutation in a certain enzyme, which was reported in the New England Journal of Medicine. The enzyme is a protein called DNMT3A, which leads to changes in how the DNA of AML patients is methylated, or "tagged." Norbert Reich, professor in the Department of Chemistry and Biochemistry at UCSB, was already studying that particular enzyme with his research group, so they began to study the disease process of AML at the cellular level.
Reich explained that tagging is a way of reading DNA at the cellular level. This falls within an area of study called epigenetics, a process that occurs "on top" of genetics. Each person has approximately 200 types of cells, all with the same DNA, and these must be controlled in different ways. "There is an enzyme -- a protein -- that tags DNA and controls which of the genes in your cells, your DNA, gets turned on and off," said Reich. "So you have 20,000 genes, and you have to control them differently in your brain than in your liver."
Reich explained that there is current interest in this broader field of epigenetics as a direction for the treatment of cancer. "There's definitely the idea that this may be a new way of developing therapeutics, because you don't have to kill the cancer cell," said Reich. "Almost every cancer therapy that's out there works on the principle that a cancer cell needs to be killed."
With epigenetics, instead of only having DNA sequence coding for certain genes, there is an epigenetic process, with another layer of information on top of the genetic process. In this case, that information is the tagging by the methyl groups.
"If you really think about it, this is part of the answer as to how your cells can be so different and yet they all have the same DNA," said Reich. "You have the same genome in every one of your cells, but you do not have the same epigenome, which is basically the methylation pattern, the tagging pattern. That is different in every type of your cells. And the way this relates back to cancer, with leukemia, in those patients, the tagging is messed up. The patterns are not correct. Our big contribution to that is we've explained how the mutations in the enzyme could lead to that disruption of the tagging pattern."
The UCSB group developed a test to demonstrate that the mutant enzymes in AML can only work on DNA for short distances. As a result, the precise methylation patterns of a healthy cell are disturbed, resulting in genes being turned on at the wrong place and time, which in turn can initiate the growth of cancerous cells.
The team found that the mutation AML patients have causes a certain complex of four proteins to be disrupted. "The surprise was that the disruption doesn't stop the enzyme from being active; it doesn't stop the enzyme from tagging the DNA," said Reich. "Instead, it stops the way it can do it. Instead of going to your DNA and tagging an entire region of chromosome, it goes there, does one thing, and leaves. That process, that change, is what we see in the AML patients. So we think we have a molecular explanation for this disease."
Reich said that the currently prescribed drug Vidaza works by affecting the same enzyme that is mutated in AML. There is interest in the pharmaceutical industry in developing other therapeutics to target the enzymes responsible for tagging the DNA. These epigenetic inhibitors would reprogram rather than kill the cell.
Traditional cancer therapies use radiation and chemotherapy to remove or kill cancer cells. "The problem with that is that cancer cells are often very subtly different from normal cells," said Reich. "So you have one of the most difficult therapeutic challenges known to man, which is to distinguish between two human cells -- one that's cancerous and one that's not. Instead of killing the cell, the notion is that if you could just reprogram the cell, then it goes back to being normal. You intercept the cancer development. This is still an aspiration; it hasn't been achieved really, but that's what attracts people to the field of epigenetic-based therapies, because of the prospect of not having to kill cells."
Celeste Holz-Schietinger and Douglas Matje, both graduate students working in the Reich lab, are the first and second authors of the paper.

Congress tries to police itself on insider trading (AP)
WASHINGTON ? Aware that most Americans would like to dump them all, members of Congress hope to regain some sense of trust by subjecting themselves to tougher penalties for insider trading and requiring they disclose stock transactions within 30 days.
A procedural vote Monday would allow the Senate later this week to pass a bill prohibiting members of Congress from using nonpublic information for their own personal benefit or "tipping" others to inside information that they could trade on.
Insider trading laws apply to all Americans, but CBS' "60 Minutes" in November said members of Congress get a pass, citing investment transactions by party leaders and a committee chairman in businesses about to be affected by pending legislation.
The broadcast report raised questions about trades of House Speaker John Boehner, R-Ohio; the husband of Democratic leader and former Speaker Nancy Pelosi of California; and Rep. Spencer Bachus, R-Ala., chairman of the House Financial Services Committee.
All three denied using any insider information to make stock trades, but the broadcast set off a flurry of efforts in Washington to deal with the public perception.
A recent Wall Street Journal/NBC News poll of registered voters found 56 percent of them favor replacing the entire 535-member Congress. Other polls this year have given Congress an approval rating between 11 percent and 13 percent, while disapproval percentages have ranged from 79 percent to 86 percent.
House Majority Leader Eric Cantor, R-Va., said he's working on an expanded bill that would go beyond stock transactions and ban lawmakers from making land deals and other investments based on what they learned as members of Congress.
The Senate version of the Stop Trading on Congressional Knowledge (STOCK) Act would subject any member of Congress who violates the ban on insider trading to investigation and prosecution by regulatory agencies and the Justice Department. It also directs the House and Senate ethics committees to write rules that would make violators subject to additional congressional penalties.
"We can start restoring some of the faith that's been lost in our government by taking this common sense step of making members of Congress play by the exact same rules as everyone else," said Sen. Kirsten Gillibrand, D-N.Y., who with Sen. Scott Brown, R-Mass., wrote the bill "We must make it unambiguous that this kind of behavior is illegal."
President Barack Obama endorsed the bill in in State of the Union speech last week, saying he would "sign it tomorrow." Brown used that opening to briefly speak with the president as he was exiting the House chamber after Tuesday's address.
"The insider trading bill's on Harry's desk right now," Brown told Obama, referring to Senate Majority Leader Harry Reid. "Tell him to get it out, it's already there."
"I'm gonna tell him," answered Obama. "I'm gonna tell him, I'm gonna tell him to get it done."
Obama raised the issue again in his radio and Internet address on Saturday.
"The House and Senate should send me a bill that bans insider trading by members of Congress, and I will sign it immediately. They should limit any elected official from owning stocks in industries they impact," he said.

OAKLAND, Calif. ? Oakland police say they arrested a total of about 150 people Saturday as protesters spent a portion of the day trying to get into a vacant convention center, and later broke into City Hall and tried to occupy a YMCA.
Police spokesman Jeff Thomason says most of the arrests came around 8 p.m. That's when police took about 100 protesters into custody as they marched through the city's downtown, with some entering a YMCA building.
About 20 demonstrators were arrested earlier in the afternoon, after police say they threw rocks, bottles and other objects at officers and tore down fencing.
Police say three officers were injured. Officers used tear gas and "flash" grenades on the protesters after they refused to leave.
Authorities were still tabulating the exact number of arrests late Saturday.

Police were in the process of arresting about 100 Occupy protesters for failing to disperse Saturday night, hours after officers used tear gas on a rowdy group of demonstrators who threw rocks and flares at them and tore down fences.
Police Sgt. Christopher Bolton said the arrests came after protesters marched through downtown Oakland a little before 8 p.m. Saturday, with some of them entering a YMCA building.
Meanwhile, about 100 police officers surrounded City Hall while others were swept the inside of the building to see if any protesters broke in.
More help from other police agencies was also on the way, with busloads of Alameda County sheriff's deputies arriving in the downtown area late Saturday.
The nighttime arrests came after 19 people were taken into custody in Occupy Oakland protests hours earlier.
Police used tear gas and "flash" grenades on the group Saturday afternoon after some demonstrators threw rocks and other objects at them. Police said three officers were hurt, but they released no details.
Police said the group assembled at a downtown plaza Saturday morning, with demonstrators threatening to take over the vacant Henry Kaiser Convention Center. The group then marched through the streets, disrupting traffic.
The crowd grew as the day wore on, with afternoon estimates ranging from about 1,000 to 2,000 people.
The protesters walked to the vacant convention center, where some started tearing down perimeter fencing and "destroying construction equipment" shortly before 3 p.m., police said.
Police said they issued a dispersal order and used smoke and tear gas after some protesters pelted them with bottles, rocks, burning flares and other objects.
Most of the arrests were made when protesters ignored orders to leave and assaulted officers, police said. By 4 p.m., the bulk of the crowd had left the convention center and headed back downtown.
The demonstration comes after Occupy protesters said earlier this week that they planned to move into a vacant building and turn it into a social center and political hub. They also threatened to try to shut down the port, occupy the airport and take over City Hall.
In a statement Friday, Oakland City Administrator Deanna Santana said the city would not be "bullied by threats of violence or illegal activity."
Interim police Chief Howard Jordan also warned that officers would arrest those carrying out illegal actions.
Oakland officials said Friday that since the Occupy Oakland encampment was first established in late October, police have arrested about 300 people.
The national Occupy Wall Street movement, which denounces corporate excess and economic inequality, began in New York City in the fall but has been largely dormant lately.
Oakland, New York and Los Angeles were among the cities with the largest and most vocal Occupy protests early on. The demonstrations ebbed after those cities used force to move out hundreds of demonstrators who had set up tent cities.
In Oakland, the police department received heavy criticism for using force to break up earlier protests. Among the critics was Mayor Jean Quan, who said she wasn't briefed on the department's plans. Earlier this month, a court-appointed monitor submitted a report to a federal judge that included "serious concerns" about the department's handling of the Occupy protests.

Chevron 4Q profit falls 3 pct on refinery decline (AP)
NEW YORK ? Chevron Corp. said Friday that net income slipped 3.2 percent in the fourth quarter as its refineries struggled to pass on the higher cost of crude oil.
The San Ramon, Calif. oil giant on Friday reported net income of $5.12 billion, or $2.58 per share, in the final three months of 2011. That compares with $5.3 billion, or $2.64 per share, in the same part of 2010. Revenue increased 11.9 percent to $60 billion.
The net income fell short of Wall Street forecasts of $2.86 per share, according to FactSet. Shares dropped $2.04, or 1.9 percent, to $104.55 in premarket trading.
Chevron, the second-largest U.S. oil company behind Exxon Mobil Corp., said that oil and natural gas production declined in the quarter. Profits from its exploration and production business increased anyway, as the company sold oil at higher prices. International natural gas prices also rose in the quarter.
The refining business struggled, however, as falling prices for retail gasoline and other fuels made it harder to pass along higher oil costs to customers. Chevron's U.S. refining operations lost $204 million from October to December, compared with a profit a year-earlier, while international refining profits fell by 46.4 percent.
For the full year, Chevron earned $26.9 billion, or $13.44 per share, compared with $19 billion, or $9.48 per share in 2010. Annual revenue increased 23.3 percent to $253.7 billion.
Exxon will release its fourth-quarter financial results on Tuesday.
Earlier in the week, ConocoPhillips reported a 66 percent increase in quarterly earnings, though much of that came from the sale of a pipeline and other assets. Occidental Petroleum Corp. reported a 35 percent jump in quarterly profits as it increased production and sold crude oil for higher prices.

Obama urges Congress to act in election year (AP)
CAMBRIDGE, Md. ? President Barack Obama rallied House Democrats for an election-year fight, urging them to work with Republicans if they show some willingness to put politics aside but telling the rank and file to call them out if they stand in the way.
Addressing Democrats on the final day of their three-day annual retreat, Obama outlined the political stakes over the next few months as congressional Democrats try to push his agenda in the face of Republican opposition, the GOP choses its nominee and signs of recovery in a fragile economy go a long way to determining his re-election chances and the party's fate.
Obama said Democrats should seize the opportunity "whenever there is a possibility that the other side is putting some politics aside for just a nanosecond in order to get something done for the American people, we've got to be right there ready to meet them," the president told the sometimes raucous crowd.
However, "where they obstruct, where they're unwilling to act, where they're more interested in party than they are in country, more interested in the next election than the next generation, then we've got to call them out on it," the president said. "We've got to push. We can't wait; we can't be held back."
Coming off a three-day tour to promote his State of the Union message, Obama promised a "robust debate about whose vision is more promising" when Republicans choose their nominee.
On a day when reports showed the economy picking up late in 2011 but still considered "fragile" by the White House, Obama told Democrats wondering about their re-election prospects: "It's going to be a tough election because a lot of people are still hurting out there and a lot of people have lost faith generally about the capacity of Washington to get anything done."
House Republicans, who held their retreat in Baltimore last week, have repeatedly said the election will be a referendum on Obama's policies, especially his handling of the economy.
The president acknowledged that Democrats have embraced parts of his agenda when it was politically difficult and in some cases costly. The party took a drubbing in the midterm elections, losing control of the House and seeing their ranks diminished in the Senate.
And despite some past clashes with House Democrats over his willingness to compromise with Republicans, Obama was warmly received and was introduced as "our champion" by Rep. John Larson of Connecticut.
The president returned the warmth with a vote of confidence that Democrats would win back the House in November, making a nod to their leader as "soon-to-be once-again Speaker of the House Nancy Pelosi."
"I believe in you guys. You guys have had my back through some very tough times," said the president, who received a small gift ? a DVD of House Democrats singing Rev. Al Green's "Let's Stay Together."
Last week, at a fundraiser at the Apollo Theater in New York, Obama stood on the stage and crooned a line from the Green classic.
Democrats were upbeat at their three-day session, energized by Obama's State of the Union address and its populist themes as well as recent polls showing more Americans say the country is on the right track and approve of Obama's handling of the economy. Divisions in the Republican ranks that were on full display last year in the fight over extending the payroll tax cut and the bitter battle between Mitt Romney and Newt Gingrich for the GOP presidential nomination also lifted Democratic spirits.
But the relationship with the White House hasn't always been cordial. Vice President Joe Biden, who addressed the Democrats prior to Obama's speech, described some of the rough patches.
He noted that several members in the room were mad at him in December 2010 after Obama negotiated an extension of President George W. Bush's tax cuts over the objections of some House Democrats. Last year, frustrated Democrats complained the Obama gave away too much in negotiating a spending bill and an agreement to raise the government's borrowing authority.
Biden said Pelosi told him at the last conference to "get tough. Enough is enough." He said the "message was heard. The message was heard. And I think we've delivered."
The vice president was more pointed in his political remarks than Obama and called out some Republicans by name. He said the American people will reject GOP unwillingness to compromise and its blatant determination to make Obama a one-term president.
Of the presidential candidates, Biden said Romney's criticism of the auto bailout and a host of positions stated by rival Newt Gingrich on government intervention will create a clear contrast for voters.
"These guys are helping us by saying what they believe," Biden said.

Obama and GOP candidates offer a campaign preview (AP)
WEST PALM BEACH, Fla. ? On a day that combined two campaigns into one, President Barack Obama on Wednesday challenged Republicans to raise taxes on the rich as GOP rivals Mitt Romney and Newt Gingrich swiped at him on the economy and criticized each other over immigration.
With a week to go before the Jan. 31 Florida Republican presidential primary, the polls suggested a tight race, although Romney and his allies seized a staggering advantage in the television ad wars. They have reported spending $14 million combined on commercials, many of them critical of Gingrich, and a total at least seven times bigger that the investment made by the former House speaker and an organization supporting him.
Obama's political timeline was a different one, Election Day on Nov. 6. In a campaign-style appearance in Iowa, he demanded Congress approve a tax increase for anyone like Romney whose income exceeds $1 million a year.
"If you make more than a million dollars a year, you should pay a tax rate of at least 30 percent. If, on the other hand, you make less than $250,000, which includes 98 percent of you, your taxes shouldn't go up," he said after touring a manufacturing plant in Cedar Rapids and in a state that he won in 2008 that was expected to be a battleground in the fall.
"This is not class warfare," he said. "That's common sense."
As Obama surely knew, it was an offer Gingrich, Romney and the anti-tax Republicans in Congress are likely to find easy to refuse.
Referring to Obama's call in the speech for Congress to end tax breaks that encourage companies to ship jobs overseas, Romney said he didn't know of any.
Instead, he said the president presides over "the most anti-business, anti-investment, anti-job creator administration I've ever seen, and so, what I'll do ? I'll get America to work again. I spent 25 years in business."
Gingrich was far harsher at an appearance in Miami.
"If he actually meant what he said it would be a disaster of the first order," Gingrich said of the president's call for higher taxes on millionaires.
The former House speaker said the president's proposal would double the capital gains tax and "lead to a dramatic decline in the stock market, which would affect every pension fund in the United States."
"It would affect every person who has a 401(k). It would attack the creation of jobs and drive capital outside of the United States. It would force people to invest overseas. It would be the most anti-jobs single step he could take," he said.
Under current law, investment income is taxed as the rate of 15 percent, a fact that has come to the fore of the campaign in recent days with the release of Romney's income tax return.
Wages, by contrast, are taxed at rates that can exceed 30 percent.
Electability is the top concern for GOP primary voters, according to polls taken in the early primary and caucus states, so both Republicans were eager to paint a contrast with the president.
But Romney and Gingrich also focused on the Florida primary now seven days distant.
Romney has long led in the state's polls, but Gingrich's upset victory last Saturday in the first-in-the-South primary in South Carolina revitalized his candidacy and raised questions about the former Massachusetts governor's staying power.
Former Pennsylvania Sen. Rick Santorum is also on the ballot, as is Texas Rep. Ron Paul.
But Santorum has been sinking in the polls as Gingrich rises, and Paul has indicated he intends to bypass the state to concentrate on caucuses to be held elsewhere.
That gives Florida the feel of a two-man race, and Romney and Gingrich are treating it that way. The two men sparred heatedly Monday night in a debate that virtually relegated Santorum and Paul to supporting roles.
A second debate is set for Thursday in Jacksonville. And if their separate appearances during the day on the Spanish-language television network Univision is a guide, it will be as feisty as the first.
Gingrich referred acidly to Romney describing a policy of "self-deportation" as a way of having illegal immigrants leave the country without a massive roundup.
"You have to live in a world of Swiss bank accounts and Cayman Island accounts and automatically $20 million income for no work to have some fantasy this far from reality," he said, referring to some of the details disclosed this week when the former Massachusetts governor released his tax returns.
"For Romney to believe that somebody's grandmother is going to be so cut off that she is going to self-deport, I mean, this is an Obama-level fantasy."
Romney's campaign swiftly produced evidence that aides to Gingrich had used the term "self-deport" approvingly, and the former governor attacked.
"I recognize that it's very tempting to come out to an audience like this and pander to the audience," Romney said. "I think that was a mistake on his (Gingrich's) part."
Gingrich also ran into trouble over a radio ad his campaign was airing that called Romney "anti-immigrant." Sen. Marco Rubio, R-Fla., who is neutral in the presidential race, criticized the commercial, and Romney said the term "anti-immigrant" was an epithet. The campaign took the ad off the air.
Gingrich made a stop in Cocoa, center of the state's now-withered space industry, and he cheered his audience by envisioning construction of the first permanent base on the moon. He also promised a "robust industry" of "commercial near-earth activities" to include science, tourism and manufacturing.
He said he hopes to stimulate investment by having the government offer prizes to private companies, but he did not elaborate. For Obama, Iowa was the first of five stops in three days following a State of the Union speech in which he stressed the theme of income equality that is expected to be one of the cornerstones of his re-election campaign. He also wove in proposals to help restore the U.S. manufacturing base that has withered in the course of the recession that began in 2008.
"Our economy is getting stronger, and we've come too far to turn back now," he told workers and guests at a conveyor manufacturing plant in Cedar Rapids. Speaking of Republicans, he said, "Their philosophy is simple: We're better off when everyone is left to fend for themselves and play by their own rules."
It's a message that may be received differently depending on the local economy.
Iowa's unemployment was most recently measured at 5.6 percent, well below the national average. In Arizona, which has its primary in four weeks, joblessness is 8.7 percent, while Nevada's at 12.6, the highest in the country. Its caucuses are Feb. 4.

with Galarus, it was frozen by one of Galarus attacks rendering it in a cyronogenic state.
It's programmed to hunt down and slay formidable marks. It is quite the hunter.

Obama doubles down on taxing the rich (Reuters)
WASHINGTON (Reuters) ? President Barack Obama used his last State of the Union speech before the November election to paint himself as the champion of the middle class, by demanding higher taxes for millionaires and tight reins on Wall Street.
Taking advantage of a huge national platform to make the case for his re-election, Obama on Tuesday defiantly defended his record after three years in office and laid blame for many of the country's woes at the feet of banks and what he called an out-of-touch Congress.
He proposed sweeping changes in the tax code and new remedies for the U.S. housing crisis, setting as a central campaign theme a populist call for greater economic fairness.
He mentioned taxes 34 times and jobs 32 times during his hour-long speech, emphasizing the two issues at the heart of this year's presidential campaign.
While the biggest proposals in Obama's speech are considered unlikely to gain traction in a deeply divided Congress, the White House believes the president can tap into voters' resentment over the financial industry's abuses and Washington's dysfunction.
But even as he called for a "return to American values of fair play and shared responsibility," Obama seemed to put no blame on himself for a still-fragile economic recovery and high unemployment that could trip up his re-election bid.
With polls showing most Americans disapprove of his economic leadership, he still faces the stiff challenge of convincing them that the candidate who was swept into the White House in 2008 promising hope and change now deserves another term.
Standing before a joint session of Congress, Obama unleashed a partisan attack over taxes and vowed no return to "the days when Wall Street was allowed to play by its own set of rules."
"Washington should stop subsiding millionaires," Obama declared as he proposed a minimum 30 percent effective tax rate on those who earn a million dollars or more.
Obama said he would ask his attorney general to establish a special financial crimes unit to prosecute those parties charged with breaking the law, and whose fraud contributed to the 2007-2009 financial crisis that plunged the United States into recession.
Obama's message could resonate in the 2012 campaign following the release of tax records by Mitt Romney, a potential Republican rival and one of the wealthiest men ever to run for the White House. He pays a lower effective tax rate than many top wage-earners.
A new proposal outlined by Obama to ease the way for more American homeowners to get mortgage relief - and to pay for the plan with a fee on banks blamed for helping create the housing crisis - also struck a populist note.
Democrats have hammered Republicans in Congress for supporting tax breaks that favor the wealthy. Republicans staunchly oppose tax hikes, even on the richest Americans, arguing they would hurt a fragile economic recovery.
"No feature of the Obama presidency has been sadder than its constant efforts to divide us, to curry favor with some Americans by castigating others," Indiana Governor Mitch Daniels said in the Republican response to Obama.
House of Representatives Speaker John Boehner, the top congressional Republican, insisted the election would be a referendum on the president's "failed" policies.
The U.S. unemployment rate was 8.5 percent in December. No president in the modern era has won re-election with the rate that high.
CHEERS AND SILENCE
Obama's rhetoric and his audience's response was more overtly partisan than last year when both sides sought a tone of
civility in the aftermath of an assassination attempt on Democratic Arizona lawmaker Gabrielle Giffords.
In the most emotional moment of the evening, Obama warmly embraced Giffords as he made his way to the podium. The congresswoman, who has made a remarkable recovery after being shot in the head, announced on Sunday she was retiring from Congress.
The response to Giffords was one of the few moments of bipartisan enthusiasm in a Congress riven by antagonism.
Democrats rose en mass to cheer, and Republicans stayed seated in stony silence, when Obama vowed to "oppose obstruction with action." But both sides applauded when Obama called for developing all domestic energy sources.
Obama used the speech to revive his call to rewrite the tax code to adopt the so-called "Buffett rule," named after the billionaire Warren Buffett, who says it is unfair that he pays a lower tax rate than his secretary.
Those making more than $1 million a year would pay an effective tax rate of at least 30 percent and their tax deductions would be eliminated.
To underscore his point, Buffett's secretary, Debbie Bosanek, was seated in the first lady's box in the House of Representatives for Obama's address.
Obama will shift into full campaign mode on a three-day tour starting on Wednesday to Iowa, Arizona, Nevada, Colorado and Michigan, all election battleground states.
In his speech, Obama also rolled out proposed corporate tax reforms, including a minimum rate on companies' overseas profits and a tax credit for moving jobs back home.
Taking aim at China - an election-year target of Republicans and Democrats alike over its currency and trade practices - Obama proposed creation of a new trade enforcement unit within the federal government.
Promising what amounts to a peace dividend, Obama also proposed using half of the "savings" from ending the war in Iraq and winding down in Afghanistan to pay down U.S. debt, with the other half going to fixing decaying roads and railways.
Addressing the housing crisis, Obama said he would send to Congress a proposal to allow more Americans to take out new and cheaper mortgages as long as they are current on their payments, savings that would amount to $3,000 per household each year. The depressed housing market continues to drag on the economy.

95% Pariah
"Pariah," from first-time writer/director Dee Rees, doesn't break much artistic ground. It tells the same gay/lesbian coming-out story that we've seen a million times. But it's told particularly well and from within a black urban context, which I don't believe has been done before. It also goes a bit deeper into the hearts and minds of the homophobic parents than typically is done, which was great. Unfortunately, it only scratches those surfaces. Kim Wayans, who of course has a long history in comedy, shows she has major dramatic talent, playing the homophobic mother of the main character. The cast is universally good, but Wayans is the stand-out. The main character is a black teenage girl in Brooklyn going through the coming-out process. She has fully come out to herself as a lesbian, and she has even found her way into a lesbian circle of friends. She even frequents a women's night club. But she hasn't told Mom or Dad about any of this, both of whom are homophobic. Mom is particularly venomous in her hatred of gays and lesbians. You can see that Dad, a detective in the NYPD, in his heart of hearts is not a bigot. Thrown into the mix to complicate things a little bit is a bisexual girl eager to have lesbian experiences to explore herself. But she tosses lesbians aside like useless candy wrappers after she's had her fun. If I were going to give Dee Rees advice, I would say this: Ms. Rees, in "Pariah" you started digging into the parent characters with some real psychological and artistic depth. I encourage you to go more deeply in that direction. I think your true gifts as an artist lie there. I would give anything to see a sequel where you explore what happened to that mother and what she's really fighting. You hint that her husband is beginning to stray, but I think there's more in there. Help us see it. Remember when that great schoolteacher tells Alike that she could "go deeper" with her poetry? You could go deeper with your films. I know you could.

Note: I am not an attorney. I just offer this exposition as the product of my personal research.
Today, I would like to talk a little bit about wire fraud and identity theft, and how they relate to the Federal statutes. In my own particular circumstance, I was a victim of witness intimidation (Title 18 ? 1512, U.S.C.), being a party (a creditor) to a bankruptcy, where there were numerous efforts to impede any manner of lawful investigation of assets. This manner of fraudulent enterprise culminated in an abusive order of protection filing, which itself invoked Federal jurisdiction with the words, ?Is a creditor in my bankruptcy,? contained in the original petition.
Why it is that the Family Law Courts would openly embrace and assist in the commission of Federal crimes is beyond me. I have no reasonable explanation for it.
So, let?s take a look at this, shall we?
Identity Theft was first criminalized at the Federal level as a part of the False Identification Crime Control Act of 1982. This was amended by the Identity Theft and Assumption Deterrence Act in 1998. This Act established Section 1028 (a) (7) of Chapter 47 of Title 18 as the Federal identity theft statute. It states:
(a) Whoever, in a circumstance described in subsection (c) of this section?
(7) knowingly transfers, possesses, or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, or in connection with, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law;
First, the statute requires a ?circumstance,? or predicate act, so that identity fraud will always consist of two actions taken together. Now, the first two paragraphs of subsection (c) deal with defrauding the Federal government (such as claiming you want some money to help battered women, then getting involved in a bankruptcy and actively assisting in witness intimidation, or using that money to go to court to prevent a song from being published), which is a big no-no. But paragraph 3 of subsection (c) invokes the powers reserved to Congress; the Commerce clause and the Postal clause:
(c) The circumstance referred to in subsection (a) of this section is that? (3) either?
(A) the production, transfer, possession, or use prohibited by this section is in or affects interstate or foreign commerce, including the transfer of a document by electronic means; or
(B) the means of identification, identification document, false identification document, or document-making implement is transported in the mail in the course of the production, transfer, possession, or use prohibited by this section.
Wire fraud, being under the Commerce clause, requires that the communication must cross state lines in order to fall into Federal jurisdiction; the Postal clause, having reserved all matters in regulating the mail, does not. In either case, each subsequent incident constitutes a separate indictable offense.
The Federal Courts have held that ?[t]here are two elements in mail fraud: (1) having devised or intending to devise a scheme to defraud (or to perform specified fraudulent acts), and (2) use of the mail for the purpose of executing, or attempting to execute, the scheme.? (Schmuck v. United States) Elsewhere, the Courts have determined that ?wire fraud is identical to mail fraud statute except that it speaks of communications transmitted by wire.? (United States v. Frey) Further, ?The fraud statutes speak alternatively of devising or intending to devise a scheme to defraud and do not require that the deception bear fruit for the wrongdoer or cause injury to the intended victim as a prerequisite to successful prosecution. [S]uccess of the scheme and loss by a defrauded person are not essential elements of the crime under 18 U.S.C. ?? 1341, 1343 . . . .? (United States v. Pollack)

? 1028A of Title 18, U.S.C., became law in 2004. This statute established aggravated identity theft as a federal crime, prohibiting the use of identifying information belonging to another in certain federal offenses and in relation to terrorism offenses.
The general provisions in subsection (a) state that:
Whoever, during and in relation to any felony violation enumerated in subsection (c), knowingly transfers, possesses, or uses, without lawful authority, a means of identification of another person?
There are five chapters of the United States Code specified in subsection (c). These are: Chapter 47 (fraud and false statements), Chapter 63 (mail, bank, and wire fraud), Chapter 69 (nationality and citizenship), Chapter 75 (passports and visas), and Chapter 8 of title II of the Immigration and Nationality Act. Any violation in any of these chapters would serve as a predicate act. There are also several sections of various chapters specified in this subsection.
Which is to say, that the use of a false identity by wire communication which travels over state lines falls into federal jurisdiction.
It looks like that to target a creditor in a pending bankruptcy proceeding in such a manner would certainly qualify as:
(c) Whoever corruptly?
(2) otherwise obstructs, influences, or impedes any official proceeding, or attempts to do so
One interesting thing to note is that these three? wire fraud (? 1343), identity theft (? 1028A), and witness intimidation (? 1512)? are all listed as predicate acts under Chapter 96 of Title 18, known as the RICO statute.
It looks more and more like that would be the standard for Ms. Katherine ?Evidence Tampering? Wessling and her scurvy crew of crooked cronies.
